The plaintiff in error was the defendant below, and the defendant in error was the plaintiff. The parties will be referred to herein as plaintiff and defendant as they appeared in the trial court.

The plaintiff brought suit against the defendant for personal injury alleged to have occurred on the defendant’s railroad at a roailroad crossing because of negligence and carelessness of defendant’s employes in operating one of its trains.
