Procedural Background
In his amended complaint in this employment discrimination action, Rosario Cavallaro (“Cavallaro” or “plaintiff’), a former employee of defendant Corning Incorporated (“Corning” or “defendant”), alleges disability discrimination and retaliation in violation of the Americans with Disabilities Act of 1990, 42 U.S.C. § 12101 et seq.
