The appellee was the plaintiff, and the appellants the defendants. The complaint charges that the defendants induced the plaintiff to enter into a written agreement, in these words:

“ April 4, 1857.

££ We, whose names are hereunto subscribed, bind ourselves to furnish M. P. Watson do Co., the number of good, fat, merchantable hogs, set opposite our names, at any convenient place in the neighborhood, between the 20th of November and the 25th of December next; no hog to weigh less than two hundred pounds, gross, for which £ J. P. Watson do Go? bind themselves to pay us $4 and 50 cents per hundred…
