MABRY, Justice.
Appellee, a workman, sued appellant Jones, employer, and the appellant surety company, under the Workmen’s Compen.sation Act, Comp.St.1929, § 156-101 et s'eq., for compensation for personal injury accidentally sustained while in the employ of Jones, recovered judgment upon the court’s finding him temporarily totally disabled, and the employer and the surety company appeal.
