On the twenty-first day of April, 1927, the appellants Philip Fenech, Sam Borg and Antonio Ciapparro entered into a contract with the city of Sacramento whereby they undertook and agreed to collect all wet garbage from the hotels, restaurants, hospitals and clubs in said city for a period of ten years and to convey the same in sanitary steel garbage wagons under the direction of the city manager of said city to a place without said city.
