SLOVITER, Circuit Judge.

Victor Darnell Thomas appeals from the judgment of conviction for possession with intent to distribute in excess of five grams of cocaine base or crack in violation of 21 U.S.C. §§ 841(a)(1) and 841(b)(l)(B)(iii), and possession with intent to distribute less than 500 grams of cocaine, in violation of 21 U.S.C. §§ 841(a)(1) and 841(b)(1)(C). He raises two issues.
