BAKER, Circuit Judge.

[1] Appellant’s bill for alleged infringement of patent No. 912,802 for a water-softening apparatus, issued February 16, 1909, to Bruce, assignor, was dismissed for want of equity.

Eleven claims are stated in the patent; but the fifth is the only one said to be infringed. It reads as follows:

“5. In a water-softening apparatus, the combination with a precipita tin?; tank, of a box supported above said tank to receive the water to be treated and provided with a relatively large opening discharging to said tank and a smaller discharge opening, a water supply pipe discharging…
