Presently before the Court is an appeal by Appellant, Nova Hut a.s. (“Nova Hut”) from the October 18, 2002 and January 6, 2003 Orders of the United States Bankruptcy Court for the District of Delaware (the “Bankruptcy Court”) denying Nova Hut’s motions (1) to stay the proceedings pending arbitration under the Federal Arbitration Act (“FAA”) and to compel arbitration under Section 206 of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards and (2) to dismiss the Third Amended Complaint filed by Debtors Kaiser Group International…
