Now before the Court is a Motion to Dismiss (“the Motion”) filed by Defendant, the City of Weatherford (“the City”), pursuant to Federal Rule of Civil Procedure 12(b)(6). Plaintiff, Terry C. Richards (“Richards”) has filed a response in opposition to the Motion to Dismiss, and the City thereafter filed a reply brief in support of the motion.
