Appellant, Millers Mutual Insurance Company, appeals from a declaratory judgment of the Lake County Court of Common Pleas in favor of appellees, Plastivax, Inc., and Ronald Hughes and Laurena Hughes. 1

Hughes, a temporary employee assigned to work for Plastivax, injured his arm while cleaning a boring mill machine at the Plastivax facility. In September 1994, Hughes filed a complaint for personal injury alleging that Plastivax had committed an intentional tort against him. 2 Plastivax demanded that appellant provide its defense and pay any judgment awarded against it.…
