MEMORANDUM OPINION AND ORDER

SMALKIN, Chief Judge.

Plaintiff, Natilya Mikhaylovna Fox (Mrs. Fox), sued the Defendants, Encounters International (“El”), Natasha Spivack, (“Ms. Spivack”), and James Fox, II (“Mr.Fox”), alleging seven causes of action. Against El and Ms. Spivack individually, she alleges fraud, violation of the Virginia Consumer Protection Act (“VCPA”), misappropriation of likeness under § 8.01-40 of the Annotated Code of Virginia, and negligence.
