Straus, J., at trial and sentence), rendered January 8, 2004, convicting defendant, after a jury trial, of robbery in the first and third degrees, and sentencing him, as a persistent violent felony offender, to concurrent prison terms of 20 years to life and SVa to 7 years, respectively, unanimously reversed, on the law, and the matter remanded for a new trial.
