This was a special proceeding under the provisions of sections 2544, 2548, Hill’s Code, to contest the right of the defendant to the office of coroner of Multnomah County, to which he was declared elected by *482the county board of canvassers. The material facts alleged are, that at the general election held in June, 1892, plaintiff was the democratic, and defendant the republican, candidate for the office of coroner; that the board of canvassers returned defendant as elected by a small plurality; that a certificate of election was issued to him, and that he ever since has been such officer.
