On November 7, 2001, at approximately 1:00 a.m., two New York City police officers patrolling in a marked car in the Upper *497West Side of Manhattan observed defendant Dwight Giles standing in a doorway of a medical office “poking” at the lock with a pocketknife. When the officers confronted defendant, he fled and was apprehended after a brief chase.
