On or about September 26, 1962, while husband and wife but having theretofore separated, the Frankenheimers entered into an agreement settling their property rights; it included the familiar provision for the agreement’s submission to the court in the event of a divorce proceeding. The following day Mrs. Frankenheimer was awarded an interlocutory decree, which judgment approved the above agreement and incorporated the same by reference. By the terms of Article III of the agreement both parties represented that they had no knowledge of any community or separate assets in their possession or…
