The controversy out of which this suit arose began on June 16, 1915, when appellee herein filed suit in the district court of McLennan county against appellant, S. Amsler, to recover the title and possession of 50 shares of stock in the McGregor Milling Grain Company, also $100 dividends alleged to have been paid to Amsler after the sale of said stock to Cavitt. This suit was numbered 22555 on the district court docket, and on December 20, 1916, it was tried, and judgment rendered in favor of appellee, Cavitt, for a specific performance of the contract for the sale of said stock, and also for…
