CUMMINGS, Circuit Judge.

This appeal from the district court’s denial of a writ of habeas corpus springs ultimately from a murder that took place on August 6, 1982. On that date, A1 Walker and Doyle Johnson robbed and shot Waymond Jackson and Donald Stewart at a rest area on Interstate 57 near Pesotum, Illinois. Although Stewart survived the shooting, Jackson died óf his wounds, turning the crime into murder.
