Appeal from a judgment of the County Court of Chemung County, rendered October 5, 1978, upon a verdict convicting defendant of the crime of robbery in the first degree. At trial defendant readily conceded an armed robbery had occurred at a gas station as alleged in the indictment, and acknowledged his participation in some of the events surrounding the commission of that offense.
