This government contracts case is before the court on the defendant’s motion to dismiss the plaintiff’s complaint for lack of subject matter jurisdiction, pursuant to RUSCC 12(b)(1) and (h)(3). The plaintiff seeks to recover its share of acquisition savings resulting from the defendant’s alleged acceptance of a Value Engineering Change Proposal (“VECP”) submitted in connection with a contract between the parties.
