Defendant/appellant, John L. Tracy, was convicted in the United States District Court for the District of Maine of three counts of distribution and attempted distribution of lysergic acid diethylamide (“LSD”) in violation of 21 U.S.C. § 841(a)(1) and § 846. Tracy also separately pled guilty to one count of failure to appear as ordered by the court, 18 U.S.C. § 3146(a)(1).
