This forfeiture action is before the Court on Plaintiffs Motion to Strike and/or Dismiss the Claim of Shawn Peek or, in the Alternative, Motion for Partial Summary Judgment. For the reasons given below, the Court denies both motions.

FACTS

Steve Peek purchased part of defendant property in 1978 and part in 1984. Steve Peek and Claimant Shawn Peek were married July 20, 1985.
