This action was brought by plaintiffs, R. J. Smith. and R. J. Smith Lumber Products, Inc., against Lewis T. Price and Red Fork Lumber Company, a corporation, to recover the sum of $3,969.86, with interest thereon at 6 per cent per annum from April 24, 1950, being the balance claimed due by plaintiffs on a debt owing them by defendants. The trial court denied the motion of plaintiffs for judgment on the pleadings and opening statement of defendants, their motion for a directed verdict, and their motion for judgment non obstante, and submitted the case to a jury which returned a verdict in…
