MEMORANDUM OPINION AND ORDER

RICHARD L. SPEER, Bankruptcy Judge.

This cause comes before the Court upon D.M. Reid Associates, Ltd./Midwest’s (hereafter “D.M. Reid”) Motion for Order Compelling Trustee, John J. Hunter, (hereafter “Trustee”) to Turnover Funds Under His Control. At the evidentiary Hearing, the parties were afforded the opportunity to present evidence and arguments they wished the Court to consider in reaching its decision.
