This is an action of contract brought to recover $3,050' paid as the purchase price of six bronze propeller blades and a condenser. The contract was made by Gordon and Gerber, copartners, as vendees with the defendant as vendor. Gerber died after this action was brought and the case is being prosecuted by Gordon who will be called the plaintiff. The case was tried by a judge without a jury who made a finding setting out the facts and his decision.
