PUTNAM, Circuit Judge.
This is a motion made on an appeal from a decree denying relief for the alleged infringement of a patent for an alleged invention owned by the complainant, now the appellant (O. C.) 92 Fed. 1005. One of the important questions raised by the appeal depends largely, if not entirely, on the construction of the claims in issue. The appellee now moves for leave to amend Ms brief in this court by introducing a prior patent, which he maintains shows the improvement which the claims in issue would cover on the construction of them which the appellant contends for.
