It is contended by appel-lees, in support of the action of the trial court in instructing a verdict in their favor: (1) That the deed.of date October 3, 1914, executed by appellants to appellee Jones was properly executed so as to take effect as a conveyance, and that the evidence offered by appellants to impeach the certificate of acknowledgment thereto was not sufficient to authorize the submission of such issue to the jury; (2) that the evidence did not establish the existence of a trust in favor of appellants in reference to the land described in said deed of conveyance;' (3) that if such…
