Appellee, A. F. Cole, as plaintiff, sued appellant W. 0. Alford, as defendant, in the district court of Smith county, in trespass to try title, to recover a described tract of land located in Smith county; and to have a certain instrument declared a mortgage which was in form a deed, executed by appellee to the law firm of Bulloch, Ramey & Storey, and to have the alleged mortgage credited with the value of certain timber, gravel, and rents converted off the premises by appellant, Alford.
