In this case we are asked to decide whether an award of statutory damages for trademark counterfeiting under 15 U.S.C. § 1117(c) precludes an award of attorney’s fees under 15 U.S.C. § 1117(b). 1

For several decades, appellee K&N Engineering, Inc. (“K & N”) has been engaged in the design, manufacture, and distribution of aftermarket automotive air filters, air intake kits, and related prod ucts.
