The information filed herein charged defendant with burglary (Pen. Code, § 459) and alleged two prior convictions of a felony. Defendant pleaded not guilty and not guilty by reason of insanity.

At the time of trial defendant admitted both prior convictions, and withdrew his plea of not guilty by reason of insanity. He was found guilty by the jury of second degree bur glary. After denial of his motion for new trial, probation was denied, and defendant was sentenced to state prison for the term prescribed by law, to run concurrently .with any. other sentence he was under…
