Affirming.

The Pioneer 'Coal & Coke Company brought -suit against the Federal Chemical Company to recover damages for violations of certain contracts for the sale of pyrites cinders. The Federal Chemical Company defended -on the ground that it was the intention -of the parties to provide in the 'Contracts that the Pioneer Coal & Coke Company .should act a-s its agent to s-el-1 on a commission basis, (but that, by mutual mistake of the parties, the 'contracts -did not represent the true agreements, hut were drawn in the form -of contracts -of sale, and…
