JOHNSON, Judge.

The State’s evidence tended to show that on 23 March 1981 at about 8:00 p.m., in a parking lot in Goldsboro, North Carolina, there was an argument between the defendant and Edward Thomas Locklear, Jr., over the defendant’s treatment of Locklear’s sister, Theresa Locklear. At this time, the defendant and Theresa Locklear were seated in defendant’s car. Edward Locklear approached the vehicle and tried to engage defendant in a fist fight.
