Plaintiffs appeal from an order of the Circuit Court of McHenry County dismissing count II of their complaint in which Robert H. Bauman was joined as a party defendant in his individual capacity. Count I of the complaint, which is still pending in the trial court, was brought against Bauman Insurance Agency, Inc., a corporation, by plaintiffs seeking recovery of damages for an alleged breach of an agency agreement between plaintiffs and the corporation. Plaintiffs joined Mr. Bauman (who was also president of the corporation) in his individual capacity seeking to enforce an indemnity agreement…
