Plaintiff in error, George J. Annes, began an action of assumpsit in the superior court of Cook county against defendant in error, Carolan, Graham, Hoffman, Inc., to recover $2000 upon a binder of insurance for the loss of a diamond ring. At the close of the evidence the court directed a verdict in favor of plaintiff in error for $2000, and judgment was entered accordingly. The Appellate Court for the First District reversed the judgment without remanding the cause and entered judgment in favor of defendant in error. The case comes to this court upon a writ of certiorari.
