Direct Mail Services, Inc., a Colorado corporation and Marvin W. Shaver, owner of the corporation, sued the United States, the State of Colorado, and certain of their representatives seeking damages arising out of the condemnation of property on which they had a lease.1

One Keith E. Best was the lessor and former owner, who leased the property to Shaver, pursuant to a written lease agreement dated October 31, 1977. The agreement was executed contemporaneously with the sale of Direct Mail Services, Inc. by Best to Shaver. Direct Mail Services had been owned by…
