NICHOLLS, J.

The issues raised in this case are stated in the reasons given for judgment by the district judge; accordingly they are herein copied:

“This is a damage suit instituted by plaintiff against defendant corporation. Plaintiff asks in his prayer that defendant be cited through its proper officer; but a citation issued, addressed to Chas. O.
