Appeal by the defendant, by permission, from an order of the Supreme Court, Kings County (Vaccaro, J.), dated November 30, 1992, which denied, without a hearing, his motion pursuant to CPL 440.10, to vacate a judgment of the same court rendered December 16, 1981, convicting him of murder in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the order is affirmed.

The defendant contends that his conviction should be vacated because the People failed to provide him with certain notes of a police witness, Gerard Walsh. We disagree.
