—Appeals by the defendant (1) from a judgment of the County Court, Orange County (Berry, J.), rendered December 9, 1997, convicting him of criminal possession of a weapon in the second degree, criminal possession of a weapon in the third degree, attempted assault in the first degree, attempted assault in the second degree, and reckless endangerment in the first degree, upon a jury verdict, and imposing sentence, and (2), by permission, from an order of the same court, dated December 14, 1999, which denied, without a hearing, his motion pursuant to CPL 440.10 to vacate the judgment.
