EVANS, Chief Justice.

The appellant sought a temporary injunction to prevent the appellee from entering upon his property. In his petition he alleged that the appellee had proceeded with a condemnation hearing on February 10, 1981, without first having served him with personal notice of the hearing, and that the appellee lacked authority to condemn an easement across his land because it had failed to obtain a Certificate of Public Convenience and Necessity from the Public Utilities Commission.
