This cause is before the court on the motions of defendant, Cytec Industries, Inc. (“Cytec”) for summary judgment (Docs.31, 59), plaintiffs opposition thereto (Docs.38, 50, 69), plaintiffs motion for summary judgment as to defendant’s counterclaim (Doc. 63), Cytec’s opposition thereto (Doc. 68), and the replies of both parties in support of their motions (Docs.42, 52, 70, 71).
