Plaintiff, Otto Ronna, was president of defendant American State Bank. Decedent, George Bohnk, on February 20, 1922, gave his note to the American State Bank for $3061.83 secured by chattel mortgage. He had a $10,000 life insurance policy in the Bankers Life, which he assigned to the bank as further collateral to this loan. On September 24, 1922, George Bohnk died, unmarried, without children. His mother was dead. His father, Hans F. Bohnk, who had been an inmate of the penitentiary since'July 17, 1917, and at the time of the trial was still, was the only heir.
