I. INTRODUCTION
This matter is back before this Court upon remand from the United States Court of Appeals for the Second Circuit “for clarification and for a proper explanation” of this Court’s ore terms order striking the Plaintiffs class action allegations and dismissing the complaint for lack of subject matter jurisdiction.
