This was an action of assumpsit brought by Edward W. Mitchell, in the Superior Court of Chicago, against 1ST. P. Lassen. It is averred, in the first count of the declaration, that defendant, on the 3d day of March, 1865, purchased of plaintiff ten thousand bushels of number one oats, at sixty-one cents per bushel, to be delivered in Chicago, by the latter to the former, during that month, and on any day thereof when the defendant might request, and to be paid for on delivery.
