HAYS, Circuit Judge:
This appeal is before us again on remand from the Supreme Court, 408 U.S. 940, 92 S.Ct. 2874, 33 L.Ed.2d 765. When the appeal was here earlier we affirmed an order of the United States District Court for the Southern District of New York, 332 F.Supp. 1009, which dismissed the appellant’s complaint on the appellee’s motion for summary judgment. The claims of the appellant are based upon his being discharged from the position of substitute teacher in the New York City school system without being accorded a full trial-type hearing on the charges against him.
