On July 12, 1916, one Edward Morgan, an employee of the defendant mining company, met death in an accident arising out of and in the course of his employment. All of the parties hereto are subject to the provisions of “plan two” of the Workmen’s Compensation Act (Chap. 96, Laws 1915). Decedent had no wife, child, father or mother. P. F.
