The whole basis of the decision below and of the majority here, in the last analysis, rests upon the proposition that it was the duty of Mrs. Edwards as the life tenant to pay the taxes, the nonpayment of which is the basis of the tax title. Assuming for the moment that there are grounds for holding that plaintiff acquired the tax title for Mrs. Edwards, which I think is absolutely without foundation in the record, and treating the case as one where Mrs. Edwards herself purchased at the tax sale and acquired the tax title, there is no basis for holding that it was her duty to pay the…
