LURTON, Circuit Judge.

This is a consolidated cause, in which are united two suits to foreclose mortgages made by the Columbus, Hocking Valley & Toledo Railway Company and the Hocking Coal & Railway Company. They will be referred to in this opinion as the “Railway Company” and the “Coal & Railroad Company.” The original foreclosure suit was filed by the Central Trust Company of New York, to foreclose a consolidated 5 per cent, mortgage of the two companies made to it as trustee, dated October 1, 1881.
