**633*727The defendant was convicted of murder in the first degree on theories of deliberate premeditation and felony-murder in the strangulation death of the victim.1 The defendant filed a motion for a new trial, arguing that his trial counsel's performance was constitutionally ineffective, particularly counsel's treatment of deoxyribonucleic acid (DNA) evidence presented by the Commonwealth.
