QUARLES, District Judge.
John H. Junck filed a voluntary petition on behalf of himself individually and of the firm of Junck & Balthazard, of which he is a member. Such petition is in the usual form, accompanied by schedules of assets and liabilities of himself and of the firm, praying for the adjudication of himself and the partnership. Balthazard, the other partner, declines to be adjudicated, and has raised an issue by his answer, in which he sets up the solvency of the firm and of each of the partners.
