Petitioner Mark Ochoa (“Ochoa”) brings this pro se petition (the “Petition”) for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 (“ § 2254”) against Dennis Breslin (“Respondent”), the superintendent of New York State’s Arthur Kill Correctional Facility. Ochoa is currently serving a sentence of ten years of imprisonment plus five years of post-release supervision following his conviction after trial in a New York State court for robbery in the second degree.
