OPINION
DAMICH, Chief Judge.
On April 6, 2004, Trek Leasing, Inc. (hereinafter “Plaintiff’ or “Trek”) filed its Motion for Partial Summary Judgment of Liability for Copyright Infringement (hereinafter “Pl.’s Mot.”) under Rule 56(b) of the Rules of the United States Court of Federal Claims (hereinafter “RCFC”). Defendant responded by filing a cross-motion for summary judgment of non-infringement (hereinafter “Def-’s X-Mot.”) on April 30, 2004. For the following reasons, Plaintiffs motion is hereby *10DENIED, and Defendant’s cross-motion is GRANTED.
